By registering on the touchatag Website, registered users (hereinafter “you”) will become entitled to obtain the benefits of the touchatag services provided by Alcatel-Lucent Bell N.V. or any of its affiliates (hereinafter "we", "our" and/or "us"). The touchatag services will enable registered users to link an RFID tag or 2D barcode (a “Tag”) with a Work (defined below) via an online web-interface (dashboard) or online Application Programming Interface (API)[1]. Each time a Tag is passed to the Touchatag service, this will "trigger" the appropriate Work, resulting in a transaction “Transaction”.

A “Work” may be the result of an Application (as defined below) which is either (i) derived from a template for an Application offered to you under the touchatag services, or (ii) created by another registered user for its own purposes and for which this registered user has agreed that this Work may be used by other registered users of the touchatag services.

The Applications and Works of registered users may be subject to additional terms and conditions imposed by such users.

As used above, an “Application” means an arrangement which requires some "configuration parameters" before it can perform Work using a Tag.

We provide 4 touchatag account types: the basic account, the developer account, the premium account and the platinum account. For each account different touchatag services and functionalities are provided to you.

The touchatag services provided under the basic account and the developer account are free and solely for non-commercial purposes, to a limitation of no more than 500 transactions using no more than 100 Tags.

We do charge fees for using other touchatag Services. When you subscribe for a premium account or a platinum account, you have the opportunity to review and accept the fees that you will be charged. We may change the fees from time to time.

We reserve the right to impose additional terms and conditions, including payment obligations.

All fees are quoted in Euros. You shall pay all fees within thirty (30) days from the receipt of invoice. Payments which are not received on the due date may bear interest at the lesser of twelve percent (12%) per annum or the maximum rate allowed under applicable law.

- Nothing herein is intended to reduce, limit, or restrict any of your rights in your Applications under copyright law or other applicable laws. Registered users shall take full responsibility for complying with the herein referred to rights and laws. However, any and all contributions made by You to the touchatag services shall be considered as freely accessible by all other users of the touchatag services, without any restrictions, unless You indicate explicitly that such free access is not allowed and that other terms apply to your Application.
- The Touchatag services are provided “AS-IS”. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE TOUCHATAG SERVICES OR ANY APPLICATION OR WORK, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR THE ABSENCE OF LATENT OR OTHER DEFECTS, ACCURACY, OR THE PRESENCE OF ABSENCE OF ERRORS, WHETHER OR NOT DISCOVERABLE.
- YOU AGREE TO INDEMNIFY US AND HOLD US HARMLESS FROM ANY CLAIMS, LOSS, COST, DAMAGE, EXPENSE OR LIABILITY, INCLUDING ATTORNEYS’ FEES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE TOUCHATAG SERVICES, THE WORK OR ANY APPLICATION AS DESCRIBED HEREIN.
